Most recently as of 2013/2014 Todd Wisner represented a client and spoke to Rochester News 8 regarding texting laws in Monroe County. Todd J.W. Wisner asked to comment in the legal publication The Daily Record on the People v. Hernandez case where Mr. Wisner represented Mr. Hernandez in a DWI case where the court suppressed the chemical breath test based upon the use of electronic signatures on the basis that they were not reliable and deprived the defendant of the right to confront the evidence. Mr. Wisner's argument and the court's reasoning was confirmed in an unrelated United States Supreme Court case Bullcoming v. New Mexico, 564 U.S. ___ (2011).

Wisner is successful in precluding the chemical test when the admissibility of breath test foundational documents are called into question due to electronic signatures and the inability to cross examine the authors of the documents.
